- The Hike User App
- The Hike Driver App
- Any related services, websites, or platforms (collectively, the “Services”)
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use Hike.
2. Nature of the Services
Hike is a technology platform that facilitates connections between users for transportation services, including:
- Rides (rideshare)
- Lifts (carpooling)
Hike does not provide transportation services and is not a transport carrier. All transportation services are provided by independent third parties.
3. Eligibility
To use the Services, you must:
- Be at least 18 years old
- Have the legal capacity to enter into a binding agreement
- Provide accurate, complete, and up-to-date information
Hike reserves the right to refuse access to any user at its discretion.
4. Account Registration and Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
You agree to notify us immediately of any unauthorized use of your account.
5. Identity and Verification
To promote safety and trust, Hike may require verification, including:
- Government-issued identification
- Proof of residence
- Driver’s license (where applicable)
- Vehicle registration documents
- Vehicle images
Hike may suspend or terminate accounts that fail verification or provide false information.
6. Driver Obligations
If you provide transportation services through Hike, you agree to:
- Maintain valid licenses and documentation
- Ensure your vehicle is roadworthy and compliant with applicable laws
- Provide accurate trip and availability information
- Act professionally and lawfully at all times
Hike reserves the right to approve, reject, suspend, or remove drivers at its sole discretion.
7. Acceptable Use
You agree not to:
- Use the Services for unlawful purposes
- Harass, threaten, or harm others
- Discriminate against any individual
- Damage vehicles or property
- Engage in fraudulent or misleading activity
Violations may result in immediate suspension or termination.
8. Payments, Pricing, and Fees
- Users agree to pay all applicable fares, fees, and charges
- Pricing may vary based on distance, time, demand, and other factors
- Payments are processed through third-party providers
Hike reserves the right to:
- Introduce or modify fees
- Adjust pricing structures at any time
9. Driver Earnings and Payouts
Drivers may earn income through completed trips.
- Earnings are calculated based on completed services
- Hike applies service fees or commissions
Payouts:
- Are processed on a periodic basis
- May be subject to verification, delays, or adjustments
Hike reserves the right to:
- Withhold or adjust earnings in cases of suspected fraud, error, or policy violations
10. Cancellations and Refunds
- Trips may be cancelled by users or drivers
- Cancellation fees may apply depending on timing and circumstances
- Refunds are issued at Hike’s discretion
11. Ratings and Feedback
Users may provide ratings and feedback.
Hike reserves the right to:
- Remove inappropriate or misleading content
- Take action against accounts with consistently poor ratings or violations
12. Safety and User Conduct
While Hike promotes safety, we do not guarantee it.
You acknowledge that:
- Interactions with other users are at your own risk
- Hike is not responsible for the conduct of any user
13. Insurance Disclaimer
Hike does not provide insurance coverage for users, drivers, or vehicles unless explicitly stated.
Users acknowledge that:
- Drivers may maintain their own insurance policies
- Hike does not guarantee the existence, validity, or adequacy of such insurance
14. Use at Your Own Risk
The Services are provided to facilitate connections between users.
Hike makes no guarantees regarding:
- Availability of services
- Quality, safety, or reliability of trips
- Conduct of users
All use of the platform is at your own risk.
15. Fraud, Misuse, and Enforcement
Prohibited activities include:
- Fake bookings or trips
- Payment fraud or chargebacks
- Abuse of promotions
Hike reserves the right to:
- Suspend or terminate accounts
- Reverse transactions
- Withhold payouts
- Report unlawful activity to authorities
16. Investigations and Enforcement Rights
Hike may, at its sole discretion:
- Investigate suspected violations
- Suspend or terminate accounts without notice
- Restrict access to the Services
- Withhold payments during investigations
17. Limitation of Liability
To the fullest extent permitted by law, Hike shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, revenue, data, or business opportunities
- Personal injury, property damage, or losses arising from use of the Services
The Services are provided “as is” and “as available.”
18. Indemnification
You agree to indemnify and hold Hike harmless from any claims, damages, liabilities, or expenses arising from:
- Your use of the Services
- Your violation of these Terms
- Your misconduct or negligence
19. Independent Contractor Relationship
Drivers operate as independent contractors.
Nothing in these Terms creates:
- An employment relationship
- A partnership or joint venture
Hike does not control or direct driver activities.
20. Service Availability
Hike does not guarantee:
- Continuous or uninterrupted access
- Availability of rides or drivers at any given time
We may modify, suspend, or discontinue any part of the Services at any time.
21. Geographic Availability
The Services are available only in selected areas and may not be accessible in all locations.
22. Force Majeure
Hike shall not be liable for delays or failures caused by events beyond its reasonable control, including:
- Natural disasters
- System failures or outages
- Government actions
- Labor disputes
23. Privacy
Your use of the Services is subject to the Hike Privacy Policy.
By using Hike, you consent to the collection and processing of your information as described in that policy.
24. POPIA Compliance
Hike complies with the Protection of Personal Information Act (POPIA) and is committed to:
- Lawful and transparent processing of personal information
- Data minimization and purpose limitation
- Implementing appropriate security safeguards
- Respecting your rights to access, correct, or delete your data
25. Termination
Hike may suspend or terminate your account immediately if you:
- Violate these Terms
- Engage in fraudulent, abusive, or illegal conduct
You may stop using the Services at any time.
26. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
27. Dispute Resolution
You agree to:
- First attempt to resolve disputes by contacting Hike support
- Allow Hike a reasonable opportunity to resolve the issue
Unresolved disputes shall be handled by courts in South Africa.
28. Entire Agreement
These Terms constitute the entire agreement between you and Hike and supersede all prior agreements or communications.
29. Changes to These Terms
Hike may update these Terms at any time.
We will notify users through the app or other appropriate channels. Continued use of the Services constitutes acceptance of the updated Terms.
