TERMS OF SERVICE

Welcome to Hike. These Terms of Service (“Terms”) constitute a legally binding agreement between you and Hike Technologies (Pty) Ltd (“Hike”, “we”, “our”, or “us”), a company registered in the Republic of South Africa, governing your access to and use of:

  • The Hike User App (iOS and Android)

  • The Hike Driver App (iOS and Android)

  • Our websites, including hikeapp.co.za

  • Any related services, platforms, features, or communications (collectively, the “Services”)

By registering an account – including verifying your email address and phone number – you expressly confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Safety & Security Policy, and any other policies incorporated by reference. Your acceptance is recorded electronically at the point of registration completion. You do not need to sign a separate paper document. If you do not agree, you must not proceed with registration or use the Services.

These Terms must be read together with our Privacy Policy and Safety & Security Policy, both of which form an integral part of this agreement.


1. DEFINITIONS

In these Terms, the following definitions shall apply:

“Hike” means Hike Technologies (Pty) Ltd, the operator of the Platform.

“User” or “Passenger” means any person who registers an account and uses the Hike User App to book transportation services, whether as a passenger in a Rideshare Trip or a Lift.

“Rideshare Driver” means an independent driver registered and approved on the Hike Driver App who provides on-demand, for-hire transportation services to Users.

“Carpool Driver” means a User who, through the Hike User App, offers surplus seating in their own private vehicle to other Users via the Lifts feature, on a cost-sharing basis only and not as a commercial transport service.

“Driver” means both Rideshare Drivers and Carpool Drivers collectively, unless the context requires otherwise.

“Trip” means a completed or in-progress ride or lift arranged through the Platform.

“Fare” means the total amount payable by a User for a completed Trip, as calculated by the Platform.

“Commission” means the service fee retained by Hike from a Rideshare Driver’s Fare on each completed Trip.

“Platform” means the Hike technology infrastructure, including the apps, websites, algorithms, communications systems, and all associated software and services.

“Content” means any text, images, ratings, reviews, photographs, or other material submitted, posted, or transmitted by you through the Services.

“POPIA” means the Protection of Personal Information Act 4 of 2013.

“CPA” means the Consumer Protection Act 68 of 2008.

“NLTA” means the National Land Transport Act 5 of 2009.

“ECTA” means the Electronic Communications and Transactions Act 25 of 2002.


2. NATURE OF THE SERVICES

2.1 Hike is a technology platform only. Hike operates a digital marketplace that connects Users seeking transportation with independent Drivers willing to provide it. The Services include:

  • Rides (Rideshare) – on-demand, for-hire transport provided by independently contracted Rideshare Drivers via the Hike Driver App.

  • Lifts (Carpooling) – non-commercial, shared-ride arrangements offered by Carpool Drivers via the Hike User App, where the payment is a contribution towards the costs of a pre-existing journey.

  • Safety Features – including the women-only driver preference, emergency contact location sharing, and in-app identity verification.

  • WhatsApp Booking Channel – an optional integration allowing Users to request and manage Trips via WhatsApp.

2.2 Hike does not provide transportation services. Hike is not a transport carrier, taxi operator, public transport service, or common carrier. All transportation services are provided solely by independent Drivers. Hike’s role is limited to facilitating the connection and processing payments on behalf of Users and Drivers.

2.3 No employment or agency relationship. Nothing in these Terms or the provision of the Services creates an employment, agency, partnership, joint venture, or franchise relationship between Hike and any Driver. Drivers are independent contractors, free to determine their own working hours (subject to the Platform’s availability), and are not under the direction or control of Hike except as explicitly set out in these Terms and any applicable Driver-specific policies. Drivers are solely responsible for their own tax affairs, insurance, vehicle maintenance, fuel, and compliance with all applicable laws.


3. ELIGIBILITY

3.1 To register and use the Services, you must:

  • Be at least 18 years of age.

  • Have full legal capacity to enter into a binding agreement under South African law.

  • Provide accurate, complete, and current information during registration and at all times thereafter.

  • Not have been previously suspended or permanently banned from the Platform.

  • Not be prohibited from using the Services under any applicable law.

3.2 We collect your date of birth at registration solely to verify that you meet the minimum age requirement. By registering, you confirm that you are 18 years of age or older. Providing a false date of birth constitutes a material breach of these Terms and may result in immediate account termination without notice.

3.3 Hike reserves the right to verify your eligibility at any time and to suspend or terminate accounts where eligibility cannot be confirmed.


4. ACCOUNT REGISTRATION AND SECURITY

4.1 Registration. To use the Services you must create an account by providing:

  • A valid email address, which will be verified before account activation.

  • A South African mobile phone number, verified via one-time PIN (OTP).

  • A clear, recent profile photograph of yourself (not a group, celebrity, or obscene image). This photograph will be visible to your matched Driver or User for identification at pickup.

  • Your date of birth and gender (gender is optional; see Section 12 regarding the women-only preference).

4.2 One account per person. You may not register more than one account. Duplicate accounts may be terminated without notice. Any attempt to circumvent this rule by using different email addresses or phone numbers is a breach of these Terms.

4.3 Account Security. You are solely responsible for:

  • Maintaining the confidentiality of your login credentials.

  • All activities that occur under your account, whether authorised by you or not.

  • Any loss or damage arising from your failure to safeguard your credentials.

You must notify us immediately at [email protected] if you become aware of any unauthorised access to or use of your account. Hike will not be liable for any loss or damage arising from your failure to comply with this obligation.

4.4 Account Accuracy. You must keep your account information accurate, complete, and up-to-date at all times. This includes promptly updating your phone number, email address, vehicle details (for Drivers), and any other material information. Hike is not responsible for any failed communications, missed Trips, or other consequences resulting from outdated information.


5. IDENTITY VERIFICATION

5.1 To maintain platform safety and trust, Hike requires identity verification for all account types. Current verification steps include:

  • Email verification (required at registration)

  • Phone number verification via OTP (required at registration)

  • Profile photograph (required for identification purposes)

  • Date of birth (for age verification)

5.2 Future verification. Hike will introduce government-issued ID document verification in a subsequent phase. This will require you to submit a scan of your valid South African ID document or passport and a real-time selfie for biometric comparison. You will be explicitly notified before this requirement takes effect, and your additional consent will be obtained at that time.

5.3 For Drivers, additional verification requirements are set out in Section 10 (Rideshare Drivers) and Section 11 (Carpool Drivers). No Driver account will be activated until all required documentation has been submitted, verified, and approved.

5.4 Hike may use third-party identity verification service providers. All such processing is conducted in accordance with our Privacy Policy. Accounts that fail verification, provide false or fraudulent documentation, or refuse to complete required verification steps may be suspended or permanently terminated without further notice.


6. USER (PASSENGER) OBLIGATIONS

6.1 As a User, you agree to:

  • Use the Services only for lawful personal transportation purposes.

  • Provide accurate pickup and drop-off locations.

  • Be ready at the designated pickup location at the booked time.

  • Treat Drivers and other Users with courtesy and respect.

  • Not request a Driver for any purpose other than the specific Trip booked.

  • Not bring into a vehicle any weapons, illegal substances, hazardous materials, or items that may cause damage or injury.

  • Not damage, soil, or misuse a Driver’s vehicle.

  • Comply with all reasonable and lawful instructions given by the Driver relating to the vehicle and safety.

  • Not record any Driver (audio or video) without their express prior consent.

  • Not share your account, login credentials, or Trips with any other person. Only you may use your account.

  • Immediately report any safety incidents, concerns, or policy violations through the in-app reporting function or via [email protected].

6.2 Violations of these obligations may result in account suspension, permanent termination, and/or legal liability for any resulting damages, including but not limited to vehicle cleaning or repair costs. Hike may, at its sole discretion, charge your payment method for such damages if the Driver makes a substantiated claim.


7. PAYMENTS, FARES, AND PRICING

7.1 Fare Calculation. Fares for Rideshare Trips are calculated automatically by the Platform based on factors including estimated distance, time, vehicle type, demand, tolls, and applicable taxes. The estimated Fare is displayed in the app before you confirm a booking. By confirming, you agree to pay the Fare as finally calculated, including adjustments for route changes, waiting time, tolls, or any other factors disclosed at the time of booking.

7.2 Surge Pricing. During periods of high demand, Hike may apply dynamic pricing (surge pricing) which increases the base Fare. Where surge pricing is active, you will be notified of the multiplier before confirming your booking. Confirming a booking during a surge period constitutes your acceptance of the adjusted Fare.

7.3 Carpool Payments. Payments for Lifts are cost-contribution amounts only. The amount displayed is not a commercial fare. Carpool Drivers receive this amount as a contribution towards the costs of the shared journey. Carpool Drivers are responsible for ensuring that the total contributions received do not result in a profit, in compliance with applicable tax and transport regulations.

7.4 Payment Processing. All payments are processed through secure third-party payment gateways. You authorise Hike to charge your selected payment method for all completed Trips and any applicable fees (including cancellation fees, cleaning fees, or damage charges). Hike does not store full payment card details.

7.5 Platform Fees. Hike reserves the right to charge a platform fee (such as a booking fee or service fee) in addition to the Fare. Any such fee will be clearly disclosed in the app before you confirm a Trip. Fees may be changed from time to time with notice to you.

7.6 Failed Payments. If a payment fails or is reversed, Hike may immediately suspend your ability to book further Trips until the outstanding amount is settled. Hike may also attempt to collect outstanding amounts from any other payment method linked to your account.

7.7 Receipts. A Trip receipt will be sent to your registered email address and be accessible in the app following each completed Trip.


8. CANCELLATIONS AND REFUNDS

8.1 Cancellation by User. You may cancel a booked Trip before the Driver arrives. Cancellations made after a Driver has been matched and has begun travelling to your pickup location may incur a cancellation fee. The applicable fee (if any) will be shown to you at the time of cancellation. Repeated or excessive cancellations may affect your account standing and ability to use the Services.

8.2 Cancellation by Driver. A Driver may cancel an accepted Trip only in genuine exceptional circumstances (e.g., safety concern, vehicle breakdown). Unreasonable cancellations by Drivers may result in suspension or removal from the Platform.

8.3 Refunds. Refunds may be issued at Hike’s reasonable discretion in circumstances including:

  • A Driver cancelled after confirmation and no alternative Driver was found.

  • A verifiable Platform error resulted in an incorrect Fare being charged.

  • A technical malfunction prevented the Trip from being completed properly.

Refund requests must be submitted via the in-app support function or to [email protected] within 48 hours of the Trip’s completion. Hike will assess the request within a reasonable period. Refunds are not issued for mere dissatisfaction with a completed Trip unless there is a verifiable Platform or Driver fault. Any refunds will be credited to your original payment method or as in-app credit, at our discretion.

8.4 No Cooling-Off Right. You acknowledge that the CPA’s cooling-off right (Section 16) does not apply to transportation services booked through the Platform, as these services are supplied immediately upon booking confirmation.


9. USER CONDUCT AND ACCEPTABLE USE

9.1 In addition to the general obligations in Section 6, you agree not to use the Services in any way that:

  • Violates any applicable law or regulation, including those relating to transport, data privacy, or public safety.

  • Harasses, threatens, intimidates, or discriminates against any Driver, User, or Hike employee on the basis of race, gender, religion, disability, sexual orientation, or any other protected characteristic.

  • Involves transporting illegal goods, weapons, or any items prohibited by law.

  • Impersonates another person or misrepresents your affiliation with Hike.

  • Attempts to manipulate the Platform, including creating fake accounts, bookings, or Trips; manipulating ratings or reviews; coordinating with others to game pricing or promotions; or using automated scripts, bots, or scrapers.

  • Attempts to bypass payment systems, use stolen payment methods, or initiate fraudulent chargebacks.

  • Records, photographs, or captures personal information about another User or Driver without their express consent.

  • Uses personal information obtained through the Platform to contact, solicit, or harass any person outside of Hike.

  • Uses the WhatsApp Booking Channel to send spam, false bookings, or abusive messages.

  • Violates our Intellectual Property rights, including reverse-engineering, decompiling, or copying the app.

9.2 Any violation of this Section may result in immediate suspension or permanent termination of your account, withholding of payments, forfeiture of credits, and referral to law enforcement where appropriate. Hike reserves the right to remove or disable any Content that violates these Terms, without notice.


10. RIDESHARE DRIVERS – SPECIFIC TERMS

This Section applies to all persons registered as Rideshare Drivers via the Hike Driver App. By completing registration as a Rideshare Driver, you agree to be bound by these additional terms.

10.1 Driver Qualification and Documentation. Before your account is activated, you must submit and maintain (as updated from time to time) the following:

  • A valid South African driver’s licence appropriate for the vehicle class.

  • A valid South African ID document or passport.

  • Proof of residential address not older than three months.

  • A current vehicle registration certificate.

  • A valid roadworthy certificate for the vehicle.

  • An operating licence or permit as required under the NLTA and applicable provincial or municipal legislation for the areas in which you operate. You are solely responsible for determining whether such a licence is required and for obtaining it.

  • Clear interior and exterior images of the vehicle that meet Hike’s quality and condition standards.

  • Valid banking details for earnings payouts.

  • Explicit consent to a criminal background check, the result of which must meet Hike’s minimum safety standards (as described in our Safety & Security Policy).

10.2 Continuous Compliance. You must ensure that all documents remain current and valid at all times. Hike may request updated documents at any time. Failure to provide a valid, up-to-date document within 7 days of request may result in immediate suspension of your account until compliance is achieved.

10.3 Vehicle Standards. Your vehicle must at all times be roadworthy, clean, smoke-free, and in a condition suitable for safe passenger transport. You must not use a vehicle that has been written off or is subject to a safety recall that has not been addressed.

10.4 Background Checks. In addition to the initial check, Hike may repeat criminal background checks periodically (at least every two years) or upon receipt of a complaint. You must notify Hike immediately if you are charged with or convicted of any criminal offence after onboarding.

10.5 Insurance. You are solely responsible for ensuring that you have a valid motor vehicle insurance policy that specifically covers the carriage of passengers for reward (commercial use). Standard personal policies typically exclude such use. You must provide proof of such insurance to Hike upon request. Hike does not verify the ongoing validity of your insurance and makes no representation that you are insured.

10.6 Independent Contractor Status. You acknowledge and agree that you are an independent contractor, not an employee, agent, or partner of Hike. You are free to choose when to log into the Platform and accept Trip requests; Hike does not control your hours or manner of work. You are solely responsible for all taxes, UIF, and any other statutory contributions on your earnings. You indemnify Hike against any claim or penalty arising from your failure to comply with tax or labour laws.

10.7 Commission and Earnings. Hike retains a Commission on each completed Trip, as shown in the Driver App. The Commission percentage may be updated with reasonable notice to you. Your net earnings will be paid out according to the published payout schedule, subject to any deductions for platform fees, chargebacks, or legitimate damage claims. Hike does not guarantee any minimum earnings or trip volume.

10.8 Conduct During Trips. You must at all times:

  • Comply with all road traffic laws.

  • Not operate while under the influence of alcohol, drugs, or any impairing substance.

  • Not use a handheld mobile device while driving.

  • Not record any Passenger (audio or video) without their express consent.

  • Treat Passengers with respect and professionalism.

10.9 Withholding of Earnings. Hike may withhold, suspend, or reverse earnings in cases of fraud, Trip disputes, chargebacks, or ongoing investigation of policy violations. Any withheld amounts will be resolved according to the outcome of the investigation.


11. CARPOOL DRIVERS – SPECIFIC TERMS

11.1 In addition to the general User obligations, Users who wish to offer Lifts must:

  • Submit a valid driver’s licence, vehicle registration, and vehicle images as prompted in the app.

  • Acknowledge that the amount received is a non-profit cost contribution, and that they are not providing a commercial taxi service.

  • Ensure that their personal vehicle insurance covers the carriage of passengers for cost-sharing, and that they are responsible for any excess or claims.

  • Accept that Hike does not conduct criminal background checks on Carpool Drivers (though it reserves the right to do so with consent).

  • Understand that the women-only preference feature is not available for Carpool Trips.

11.2 Carpool Drivers are not required to hold an operating licence, but they must comply with all general road traffic and vehicle safety laws.


12. WOMEN-ONLY DRIVER PREFERENCE FEATURE

12.1 Hike offers an optional feature that allows female Users to be matched exclusively with female Drivers (both for Rideshare and, where available, for Lifts). This feature is available only to Users who have identified their gender as female.

12.2 Enabling this preference may result in longer wait times or reduced driver availability. Hike does not guarantee that a female Driver will be available at any given time.

12.3 Gender information is classified as special personal information under POPIA. It is collected solely for the purpose of enabling this safety feature and for anonymised statistical analysis. You are not required to disclose your gender; if you do not, the women-only preference will not be available to you. See our Privacy Policy for details on processing.


13. WHATSAPP BOOKING CHANNEL

13.1 Hike offers an optional WhatsApp-based Trip booking channel, integrated via the Meta WhatsApp Business API. By enabling this feature, you:

  • Authorise Hike to link your registered phone number with your WhatsApp account.

  • Acknowledge that messages sent via WhatsApp are subject to Meta’s Terms of Service and Privacy Policy in addition to these Terms.

  • Accept that the delivery and timeliness of WhatsApp messages are outside Hike’s control; Hike is not liable for any failure or delay in the WhatsApp channel.

  • Agree not to misuse the channel for false, fraudulent, or abusive bookings.

13.2 You may disable this feature at any time through in-app settings or by contacting support. Disabling WhatsApp does not affect your ability to book through the app.


14. SAFETY FEATURES AND DISCLAIMER

14.1 Hike implements various safety features as described in our Safety & Security Policy, including GPS trip tracking, an in-app emergency (panic) button, route deviation detection, and optional emergency contact location sharing. You are encouraged to use these features if you feel unsafe.

14.2 The panic button is not a monitored alarm. Activating it will display your location and trip details and provide quick access to emergency numbers, but Hike does not guarantee an immediate response. In a genuine emergency, you must contact emergency services directly (10111, 10177, or 112).

14.3 No guarantee of safety. While Hike invests significantly in safety, we cannot guarantee that all incidents will be prevented. You acknowledge that interacting with other individuals carries inherent risks, and you assume those risks to the fullest extent permitted by law. Hike is not responsible for the conduct of any User or Driver, whether on or off the Platform.


15. RATINGS, REVIEWS, AND CONTENT

15.1 Users and Drivers may rate each other and provide feedback after each Trip. Ratings are used to maintain quality and safety.

15.2 You agree that your ratings and reviews will be honest, based on your actual experience, and free from defamatory, obscene, or abusive content. Hike reserves the right to remove any Content that violates these standards, without notice.

15.3 By submitting Content, you grant Hike a non-exclusive, transferable, sub-licensable, royalty-free, worldwide licence to use, reproduce, modify, display, and distribute that Content in connection with the Platform. This licence survives termination of your account.

15.4 Accounts with sustained low ratings below the minimum threshold (as published in the app) may be subject to warning, re-training, suspension, or termination.


16. INTELLECTUAL PROPERTY

16.1 All intellectual property rights in the Hike Platform, including the software, apps, websites, logos, trademarks, algorithms, and all content created by Hike, are owned by or licensed to Hike Technologies (Pty) Ltd. Nothing in these Terms grants you any right, title, or interest in any of our IP.

16.2 Hike grants you a limited, non-exclusive, non-transferable, revocable licence to use the Services solely for your personal, non-commercial use (or, for Drivers, for the purpose of providing transportation services) and in accordance with these Terms. This licence terminates automatically upon suspension or termination of your account.

16.3 You must not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works based on the Hike Platform, nor use Hike’s name, logo, or trademarks without our prior written consent.


17. PRIVACY AND DATA PROTECTION

17.1 Your use of the Services is governed by our Privacy Policy, which forms part of these Terms. By using the Services, you consent to the collection, processing, and sharing of your personal information as described in that Policy.

17.2 Hike complies with POPIA. The Privacy Policy sets out your rights as a data subject and how to exercise them. In the event of any inconsistency between these Terms and the Privacy Policy regarding data protection, the Privacy Policy shall prevail.


18. THIRD-PARTY SERVICES

The Services may contain links to or integrations with third-party services (e.g., payment gateways, mapping providers, WhatsApp). Hike is not responsible for the availability, content, or practices of any such third-party services. Your use of them is at your own risk and subject to the terms of those third parties.


19. INSURANCE DISCLAIMER

Hike does not provide any insurance – whether personal accident, vehicle, public liability, or otherwise – to Users or Drivers, unless expressly stated in a separate written agreement. It is the Driver’s sole responsibility to maintain adequate insurance as required by law and these Terms. Users are strongly advised to have their own personal accident or travel insurance.


20. LIMITATION OF LIABILITY

20.1 To the fullest extent permitted by South African law, including the CPA where applicable, Hike’s total aggregate liability to you for any claim arising out of or in connection with these Terms or the Services shall not exceed the higher of:

  • The total Fares paid by you (or, in the case of a Driver, the Commission earned by Hike from you) in the three (3) months immediately preceding the event giving rise to the claim; or

  • ZAR 1,000 (one thousand Rand).

20.2 Hike shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunity, even if advised of the possibility of such damages.

20.3 Without limiting the above, Hike specifically disclaims liability for:

  • Personal injury, death, or property damage arising from the transportation services provided by any Driver.

  • The acts, omissions, or conduct of any User or Driver.

  • Service interruptions, app downtime, GPS inaccuracies, or network failures.

  • Loss or corruption of data.

  • The accuracy or reliability of user-generated Content.

20.4 Nothing in these Terms excludes or limits Hike’s liability for:

  • Death or personal injury caused by Hike’s own gross negligence or wilful misconduct.

  • Any liability that cannot be lawfully excluded under the CPA or other mandatory South African legislation.

20.5 You acknowledge that the Services are provided “as is” and “as available,” and Hike makes no warranties, express or implied, regarding the availability, reliability, quality, or fitness for a particular purpose.


21. INDEMNIFICATION

21.1 You agree to defend, indemnify, and hold harmless Hike Technologies (Pty) Ltd, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees on an attorney-and-client scale) arising out of or related to:

  • Your breach of these Terms.

  • Your use of the Services.

  • Your violation of any law or the rights of a third party.

  • Your wilful misconduct, negligence, or fraud.

  • In the case of a Driver, any claim by a Passenger, third party, or regulator arising from your transportation services, including but not limited to claims for personal injury, property damage, uninsured losses, or regulatory penalties.

21.2 This indemnity shall survive termination of your account and these Terms.


22. ACCOUNT SUSPENSION AND TERMINATION

22.1 Termination by Hike. Hike may, at its sole discretion, suspend or permanently terminate your account immediately and without prior notice if you:

  • Breach any material term.

  • Engage in fraudulent, abusive, or unlawful conduct.

  • Fail verification or document renewal.

  • Pose a safety risk.

  • Accumulate sustained low ratings.

  • Provide false information.

22.2 Appeal. You may appeal a suspension or termination by emailing [email protected] within 14 days. Hike will review your appeal and respond within a reasonable time, but submission of an appeal does not guarantee reinstatement.

22.3 Termination by You. You may terminate your account at any time via the in-app function or by contacting support. Outstanding obligations (e.g., unpaid fares, damage charges) survive termination.

22.4 Effect of Termination. Upon termination, your licence to use the Platform ceases immediately. Outstanding Driver earnings that are not in dispute will be paid out on the next scheduled payout date. Your personal data will be handled in accordance with our Privacy Policy.


23. FORCE MAJEURE

Hike shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure arises from circumstances beyond its reasonable control, including natural disasters, extreme weather, pandemics, government action, civil unrest, power or internet outages, or third-party system failures. In such events, Hike will use reasonable efforts to restore service as soon as practicable.


24. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa. You consent to the non-exclusive jurisdiction of the courts of South Africa for any dispute. Nothing in this clause prevents Hike from seeking urgent or interim relief in any court of competent jurisdiction.


25. DISPUTE RESOLUTION

25.1 Informal Resolution. Before initiating any formal legal proceedings, you must first contact Hike at [email protected] and allow us 15 business days to attempt to resolve the dispute amicably.

25.2 Mediation. If the dispute is not resolved informally, either party may refer the matter to confidential mediation under the auspices of an accredited mediation body (such as AFSA). Mediation shall be a prerequisite to litigation, unless a party seeks urgent interim relief.

25.3 Litigation. If mediation fails, either party may approach a competent court. Nothing in this Section limits your right to approach an applicable ombud or the National Consumer Tribunal, as provided under the CPA.


26. CHANGES TO THESE TERMS

26.1 Hike may update or amend these Terms at any time. Material changes will be communicated via in-app notification, email, and an updated “Last Updated” date.

26.2 Unless the change is required by law or addresses an urgent safety or security matter (in which case it takes effect immediately), material changes will take effect 14 days after notification. Your continued use after that date constitutes acceptance. If you do not agree, you must stop using the Services and may request account deletion.


27. GENERAL PROVISIONS

27.1 Entire Agreement. These Terms, together with the Privacy Policy, Safety & Security Policy, and any other policies incorporated by reference, constitute the entire agreement between you and Hike and supersede all prior agreements or representations.

27.2 Severability. If any provision is found to be invalid or unenforceable, that provision shall be severed and the remainder shall continue in full force.

27.3 Waiver. Hike’s failure to enforce any right shall not constitute a waiver of that right.

27.4 Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. Hike may assign these Terms to an affiliate or in connection with a merger, acquisition, or asset sale without your consent.

27.5 Third-Party Rights. These Terms do not confer any rights or remedies on any person other than the parties.

27.6 Language. These Terms are drafted in English. In any translated version, the English text shall prevail.

27.7 Electronic Agreement. You agree that clicking “Register” or “I Agree” constitutes your electronic signature as defined in ECTA and that you intend to be legally bound. All records of your acceptance will be stored by Hike.
